Le groupe de construction Shinhan engagea une poursuite contre l'actrice Choi Jin Sil pour ce qu'ils croient être un bris de contrat de sa part lorsqu'elle était représentante pour eux en 2004. La cour pencha préalablement en faveur de Choi en 2004, mais l'entreprise fit appel de la décision l'année dernière (quelque temps avant son suicide) et la Cour Suprême de la Corée du Sud renversa le verdict précédant, accordant 1.1 billion de dédommagements à l'entreprise. Tiré du Korea Herald: la Cour Suprême dicta "Les mannequins qui ne réussissent pas à garder une dignité convenable en tant que représentant des produits qu'ils représentent doivent dédommager leur client pour les dommages causés à leur image".
Mais qu'est-ce que Choi Jin Sil a fait pour devenir une représentante "inappropriée"? Comment a t'elle failli à "maintenir une dignité convenable"? Et bien, en 2004, pendant son contrat avec le groupe Shinhan, Choi Jin Sil a été battu par son mari, Cho Sung Min.
L'incident fut hautement publicisé et il est clair que Choi n'a pu garder la même image qu'auparavant. Mais est-elle responsable de la violence de son mari? Le premier jugement déclara que non, établissant qu'elle ne pouvait pas être tenue responsable de la violence de son mari. Mais la Cour Suprême jugea que:
"Le but du contrat de représentante de produit est d'utiliser la réputation sociale et les images du modèle pour attirer l'intérêt des clients, l'échec du représentant à maintenir une image adéquate constitue un manquement au contrat d'embauche."
C'est vrai mais, qui ose poursuivre une femme pour avoir été abusé par son propre mari? Comment une Cour Suprême peut donner raison au plaintif dans une telle demande d'appel? Ce jugement met en place un précédant apeurant et extrêmement sexiste.
Shinhan demanda un dédommagement de 3 billions (1,7 million en $ US) des 5 billions (2,8 millions) de l'héritage des enfants de la défunte Choi. Malgré cela, la cour leur accorda 1.1 billion (moins de la moitié du montant statué au contrat pour bris d'engagement soit 630,000$ US). Même si l'entreprise ne reçoit pas le montant qu'ils souhaitaient au départ, ils repartent quand même avec 1/5 des biens de Choi Jin Sil. Pourquoi? Parce qu'ils croient que Choi Jin Sil est responsable pour avoir été battue par son ex-mari. J'espère que la famille de Choi en appellera de cette décision. Et j'espère que les gens scandalisés et le démontre. Ceci est extrêmement irrespectueux pour la défunte Choi Jin Sil, vivante ou morte.

Shinhan construction company filed a suit against actress Choi Jin Sil for what they perceived as her not fulfilling her duties as a spokesperson for them in 2004. The suit was won in Choi’s favor back in 2004 but the company appealed last year (most likely, hopefully, before her suicide) and the Supreme Court overturned the ruling, granting Shinhan 1.1 billion in a settlement. From the Korea Herald: ”‘Models who failed to maintain appropriate dignity as representatives of the products they represent should compensate for the damages caused to their advertiser’, the top court ruled.”
What did Choi Jin Sil do to become an “unsuitable” spokesmodel? How did she fail to “maintain appropriate dignity”? Well, back in 2004, while under contract with Shinhan, Choi Jin Sil was beaten by her husband, Cho Sung Min.
The incident was highly publicized and clearly Choi didn’t have the same image she had before. But is she responsible for her husbands violence? A lower court ruled no, stating that she could not be held responsible for her then-husband’s violence. But the supreme court felt that:
“The purpose of the brand model contract is to use the model’s social reputation and images to draw the customers’ interest, the model’s failure to maintain an adequate image constitutes a breach of the hiring contract.”
This is true but once again, how dare anyone sue a woman for being victimized by her own husband? How can a supreme court rule in favor of such an appeal? This ruling sets a scary and extremely sexist precedent.
Shinhan asked for 3 billion ($1.7m) won of Choi’s 5 billion (2.8m) won estate left to her children. However, the court granted them a total of 1.1 billion won (less than half of which was compensation for breach of contract as stated in the contract)($630,000). Though the company isn’t getting the 3 billion they asked for they’re still taking over 1/5th of Choi Jin Sil’s estate. And why? Because they think Choi Jin Sil is responsible for getting beat up by her ex-husband. To say I’m disgusted and offended would a pretty accurate representation of what I’m feeling. I hope that Choi’s family appeals this Supreme court decision. And I hope people are outraged and show it. This is extremely disrespectful to the late Choi Jin Sil, alive or deceased.
